Terms of Service

These Terms of Service (“Terms”) govern your use of After8 at after8.app, operated by [After8 Inc./LLC] (“After8,” “we,” “us”). By using the service, you agree to these Terms. If you don’t agree, don’t use the service.

After8 helps you find same-night rates at nearby hotels. You send an offer, the front desk accepts or counters, and if you agree on a rate you book the room and pay the hotel directly at check-in. After8 doesn’t process payments or charge you a booking fee.

You can search and make offers without an account. If you create one, you must be at least 18 years old, and you’re responsible for keeping it secure and for activity that happens under it. Let us know right away if you suspect unauthorized use.

When you confirm a rate with a hotel, you’re agreeing to show up for that night on the terms stated in the chat, and the hotel is agreeing to hold the room at that price. If you can’t make it, cancel in the app. Repeated no-shows may be recorded and can limit your ability to make offers across the After8 network.

You pay the hotel directly at the front desk when you check in. After8 doesn’t collect payment, hold funds, or store card details. Taxes and any incidentals are handled by the hotel under its own policies.

To confirm a booking and reduce spam, we may ask you to verify a phone number. Standard message and data rates from your carrier may apply.

You agree not to:

• Provide false or misleading information, or impersonate anyone.
• Harass hotel staff, or use the negotiation chat for anything other than arranging a stay.
• Interfere with, scrape, overload, or attempt to gain unauthorized access to the service.

We work to keep After8 running reliably, but we provide the service “as is” and “as available,” without warranties of any kind. We don’t guarantee that any hotel will accept your offer, that a room will be available, or that the service will be uninterrupted or error-free.

To the fullest extent permitted by law, After8 and [After8 Inc./LLC] won’t be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, or from your stay at any hotel. Your agreement for the stay itself is with the hotel, not with After8. Our total liability for any claim relating to the service is limited to USD $100.

You can stop using After8 at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive — such as liability limits — will continue to apply.

These Terms are governed by the laws of [State], United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located there.

We may update these Terms from time to time. When we do, we’ll revise the effective date above, and continued use of the service after a change means you accept the updated Terms.
